KOŞULLU SALIVERİLME KARARININ GERİ ALINMASI

Abstract

Ceza adalet sistemini tamamlayan, cezanın özel önleme amacınahizmet eden ve infaz sırasında cezanın bireyselleştirilmesini sağlayanbir infaz kurumu olan koşullu salıverilme, cezaevinde bulunduğu sü reyi iyi halli geçirmesi nedeniyle ıslah olduğu düşünülen hükümlününyeniden topluma kazandırılması aracıdır. Belirlenen denetim süresiniyükümlülüklerine uygun ve iyi hâlli olarak geçiren hükümlünün ceza sı infaz edilmiş sayılır. Bunun aksine, koşullu salıverilen hükümlünün,denetim süresi içinde işlediği kasıtlı suçtan hapis cezasına mahkûmolması veya kendisine yüklenen yükümlülüklere, infaz hâkiminin uya rısına rağmen, uymamakta ısrar etmesi hâlinde koşullu salıverilmekararı geri alınır. Bu durumda hükümlünün; sonraki suçu işlediği ta- rihten itibaren başlamak ve hak ederek tahliye tarihini geçmemekşartıyla, sonraki işlediği her bir suç için verilen hapis cezasının iki katısürenin, yükümlülüklerine aykırı davranması hâlinde ise, yükümlü lüklere uymamakta ısrar ettiği tarih ile hak ederek salıverilme tarihiarasındaki süreyi geçmemek şartıyla ihlalin niteliğine göre infaz ha kimince takdir edilecek bir sürenin, infaz kurumunda çektirilmesinekarar verilecektir.
