Mültecilerin adalete erişimi

Abstract

Üç bölümden oluşan çalışmamızın birinci bölümünde, mülteci hukuku ile ilgili ulusal ve uluslararası mevzuat çerçevesinde temel bilgiler verilmiştir. Bu bağlamda, mülteci kavramının uluslararası sözleşmelerdeki tanımları ile iç hukuktaki tanımları yapılmıştır. Ayrıca Mülteci Hukukunun tarihsel gelişimi, mülteci statüsünün belirlenmesi ve mültecilerin hak ve özgürlükleri konusunda açıklamalar yapılmıştır. Çalışmamızın ikinci bölümünde ise, tez konumuzun esasını kuvvetlendirecek adalete erişim kavramı ve adalete erişim hakkı ile ilgili temel bilgiler verilmiştir. Adalete erişim hakkının tarihsel süreci ile ilgili bilgi verildikten sonra söz konusu hakkın uluslararası sözleşmelerde ve iç hukuktaki yeri ile ilgili hususlar irdelenmiştir. Adalete erişimin adil yargılanma hakkı ve adli yardım kurumu ile olan bağlantısı nazara alınarak, adil yargılanma hakkı ve adli yardım mekanizması ile ilgili detaylı bilgiler verilmeye çalışılmıştır. Çalışmamızın son bölümünde mültecilerin adalete erişimi hakkının uluslararası hukuk ve iç hukuktaki yeri tespit edilmeye çalışılmıştır. Mültecilerin adalete erişimi hakkı kapsamında adil yargılanma hakkı, etkili başvuru hakkı, adli yardım ve avukat hizmetinden faydalanma hakkı gibi temel hak ve özgürlükleri ile ilgili bilgiler verildikten sonra, söz konusu haklara erişim noktasında yaşadıkları sıkıntılar irdelenmiştir. Ayrıca sınırdışı etme yasağı ve geri göndermeme ilkesi ulusal ve uluslararası mevzuata göre incelenmiştir. In the first chapter of our three-part study, basic information about refugee law within the framework of national and international legislation was examined. In this context, definitions of the concept of refugees in international conventions and domestic law have been made. In the second chapter of our study, basic information about the concept of access to justice and the right to access to justice is given to strength the basis of our thesis. After being informed about the historical process of the right to access to justice, issues related to the place of this right in international conventions and domestic law were examined. In view of the connection between access to justice and the right to a fair trial and the legal aid agency, detailed information about the right to a fair trial and the legal aid mechanism has been tried. The last chapter of our study brought to establish the place in international law and domestic law of the right of refugees to access justice. Furthermore, refugees were examined after they were informed about the difficulties of access to these rights in their fundamental rights and freedom such as the right to a fair trial, the right to the effective application of the right to benefit from the services of lawyers and legal aid within the scope of the right to the right to access to justice. The most violations of access to justice have been experienced; the ban on deportation and the principle of non-repatriation have been examined in accord with national and international legislation.
