Mal Sigortası Sözleşmesinde Malike Ait Menfaatin Sınırlı Ayni Hak ile Sınırlandırılması

Abstract

Sigorta sözleşmesiyle kişilerin menfaatleri güvence altına alınır. Bir mal üzerinde birden fazla kişinin menfaatinin olması olağan bir durumdur. Bu nedenle birden fazla kişinin menfaati sigorta ettirilebilir. Bu durumda kurulan söz- leşmeler, her biri için ayrı birer sigorta sözleşmesi olarak değerlendirilir. Bunun sonucunda her menfaat sahibi kendi sözleşmesinden doğan haklardan yararlanır. Bunun bir istisnası olacak şekilde yasal düzenlemeyle malike ait menfa- atin sigorta ettirildiği durumlara özgü olarak bu sözleşmeden doğacak tazminat için sınırlı aynî hak sahibine de hak tanınmıştır. Çalışmamızda, sınırlı aynî hak sahibinin, aynî hak tesis ettiği malın sigorta ettirildiği durumda bu söz- leşmeden doğacak olası bir tazminat üzerinde hak sahibi olabilmesinin şartları, tazminatın ödenmesi ve sigortacıya getirilen birtakım yükümlülükler incelenmiştir.

The interests of persons are secured by the insurance contract. And it is common that more than one person to have interests on a single property. Therefore, the multiple interests of multiple persons over a single property can be insured. The contracts established in this context are considered as separate insurance contracts for each person. As a result, each person takes advantage of the rights arising from his/her own contract. Also, there is a legal exception to this rule. If an interest of the owner of a property is insured under the insurance contract, in addition to the owner, the person with the limited real rights over that property also takes advantage of the rights arising from this insurance contract. In our study; the conditions required for the limited real right owner to be entitled to a possible compensation arising from property’s insurance contract, the payment of the compensation, and some obligations imposed on the insurer are examined.
