Ölünceye kadar bakma sözleşmesine dayalı tapu iptali ve tescil davaları

Abstract

Günümüzde gittikçe yalnızlaşan insanların maddi ve manevi ihtiyaçları bakımından ölünceye kadar bakma sözleşmesine olan ilgilerinin arttığı şüphesizdir. Bu haliyle artan sözleşme kullanımı, çok çeşitli hukuki sorunlar doğurmaktadır. Tez çalışmamızda ölünceye kadar bakma sözleşmesine dayalı olarak farklı hukuksal nedenlerle açılan tapu iptali ve tescil davaları incelenmektedir. Bu kapsamda öncelikle sözleşmenin tanımı, özellikleri, unsurları, diğer sözleşmelerle farkları, tarafları, şekli ve sona erme nedenleri incelenmekle birlikte sözleşme ortaya konulmaktadır. Akabinde bu sözleşme nedeniyle açılan tapu iptali ve tescil davalarının çeşitleri, davanın taraflarının kimler olabileceği ve davanın diğer hususları hakkında doktrin ve yargı kararları çerçevesinde hem teorik hem de pratik bir bakış açısıyla eleştirel bir çalışma yapılmaya çalışılmıştır.There is no doubt that today, people who are getting lonelier and lonelier, are more interested in the contract of care until death in terms of their physical and spiritual needs since the increasing use of contracts creates a wide variety of legal problems. In our thesis, the deed cancellation and registration cases filed for different legal reasons based on the contract of care until death are examined. In this context, firstly, the definition of the contract, its features, elements, differences with other contracts, parties, form and termination reasons are examined and the contract is revealed. Subsequently, a critical study has been tried to be made from both a theoretical and a practical point of view, within the framework of doctrine and judicial decisions, about the types of title cancellation and registration lawsuits filed due to this contract, who the parties may be, and other aspects of the case.
