Türk idare hukukunda kişisel verilerin korunması

Abstract

Türk İdare Hukukunda Kişisel Verilerin Korunması isimli yüksek lisans tez çalışması giriş, üç bölüm ve sonuçtan oluşmaktadır. Bu çalışmada idarenin kamu hizmetini yerine getirmek amacıyla işlediği kişisel verilerin niteliği, idarenin sorumluluğu ve hukuki denetimi incelenmiştir. Bu doğrultuda birinci bölümde; kişisel veri kavramının doğuşu, hukuki dayanağı, kişisel verinin tanımı, unsurları, çeşitleri, veri işleme faaliyetinin tarafları, veri işlerken uyulması gereken genel ilkeler ve işleme şartları tespit edilmiştir. İkinci bölümde; Kişisel Verileri Koruma Kurumuna, idarenin veri işleme faaliyetinden kaynaklanan hukuki sorumluluğuna ve bu sorumluluğu etkileyen hallere değinilmiştir. Üçüncü bölümde ise; veri işleyen idarenin hukuki denetiminin gerekliliği, idarenin yargı dışı denetimi ve yargısal denetimine yer verilmiştir. The master's thesis study titled Protection of Personal Data in Turkish Administrative Law consists of introduction, three sections and results. In this study, the nature of the personal data processed by the administration in order to perform public service, the responsibility of the administration and the legal audit are examined. Accordingly, in the first part; the birth of the concept of personal data, its legal basis, definition of personal data, elements, types, parties to data processing activity, general principles and processing conditions to be observed when processing data have been determined. In the second part; The Personal Data Protection Authority has been addressed to the administration's legal responsibility for data processing activities and the circumstances affecting this responsibility. In the third part; the necessity of legal auditing of the data processing administration, the extrajudicial audit and judicial supervision of the administration are included.
