Türkiye'de çoklu boşanma sistemi

Abstract

Boşanma davalarında görülen en önemli meselelerden biri davaların uzun sürmesi ve bunun ortaya çıkardığı sorunlardır. Bu çalışmayı yapmaktaki amaçlarımız boşanmanın kişisel ve malî sonuçları üzerinde kusurun etkilerini, boşanmanın kişisel ve malî sonuçlarının aynı dava içinde görülmesi ile taraflar hakkında yapılan kusur incelenmesinin davaların çok uzun sürmesi üzerinde etkisini ve davaların uzun sürmesinin oluşturduğu olumsuzlukları araştırmaktır. Çalışmada yapılan tespitler doğrultusunda mevcut boşanma hükümlerinde yapılabilecek değişiklikler hususunda öneriler sunmaktır. Çalışma sonunda; davaların çok uzun sürmesiyle eşlerin fikren ve fiilen bitirdikleri evlilik birliğine hukuken yıllarca devam etmek zorunda kaldıkları, dolayısıyla yıllarca özellikle boşanmanın kişisel sonuçlarından olan haklarını kullanamamaları nedeniyle mağduriyetlerine sebep olduğu tespit edildi. Yaptığımız çalışmada, boşanma davalarında sadece genel boşanma sebeplerine yer verilmesi ve kusurun boşanmanın sebepleri değil, sonuçları bakımından dikkate alınmasının daha isabetli olacağı ve boşanma davalarının 'boşanmaya karar verilmesi ve çocuklara ilişkin kısım' ve 'boşanmanın malî sonuçlarına ilişkin kısım' şeklinde ikiye ayrılarak görülmesinin mümkün ve faydalı olacağı sonucuna varıldı.

One of the most important issues seen in divorce cases is the long duration of the cases and the problems it creates. Our aim in doing this study is to investigate the effects of fault on the personal and financial results of divorce, the effects of the personal and financial consequences of divorce on the same lawsuit, the effect of the fault examination on the parties on the long duration of the lawsuits, and the negative effects of the long duration of the lawsuits. In line with the determinations made in the study, it is to offer suggestions about the changes that can be made in the existing divorce provisions. At the end of the study; It was determined that the spouses had to legally continue the marriage union that they had ended intellectually and de facto for many years due to the long duration of the cases, thus causing their grievances for years, especially because they could not use their rights from the personal consequences of divorce. In our study, it is more appropriate to include only the general reasons for divorce in divorce cases and to consider the fault in terms of the consequences, not the reasons for the divorce, and it is possible to see the divorce cases by dividing them into two parts as 'the part related to the decision to divorce and the children' and 'the part related to the financial consequences of the divorce'. concluded that it would be beneficial.
