Uluslararası ticareti düzenleyen kurallar ve düzenlemeler

Abstract

Uluslararası ticaretin giderek yaygınlaşması ve her ülkenin kendine ait ticari uygulamalarının olması taraflar arasında birtakım uyuşmazlıkların yaşanmasına yol açmaktadır. Dış ticarette ortaya çıkabilecek bu gibi sorunların engellenmesi için ticari kuralların yeknesaklaştırılması ihtiyacı ortaya çıkmıştır. Bu kapsamda, küresel düzeyde etkinliği olan Milletlerarası Ticaret Odası (International Chamber of Commerce-ICC) ve Birleşmiş Milletler gibi bazı kurumlar çeşitli çalışmalar yaparak bu uyuşmazlıkları gidermek üzere bazı konularda birörnek kurallar oluşturmuşlardır. Belirlenen kuralların en öne çıkanları, satış sözleşmeleri için oluşturulan Milletlerarası Mal Satımına İlişkin Sözleşmeler Hakkında Birleşmiş Milletler Antlaşması ya da Viyana Antlaşması ile ICC tarafından oluşturulan teslim şekillerine ilişkin Incoterms Kuralları, Akreditiflere İlişkin Birörnek Usuller ve Uygulama Kuralları, Vesaik Mukabili Ödeme İşlemlerine İlişkin Tahsiller için Birörnek Kurallar ve Garantilere İlişkin Birörnek Kurallardır. Yapılan bu çalışmanın birinci bölümünde; küreselleşme süreci, uluslararası ticaretin gelişimi ve dış ticarette kullanılan belgeler üzerinde durulmuş ve Viyana Antlaşması incelenmiştir. İkinci bölümde ise ICC'nin belirlemiş olduğu ve en yaygın kullanıma sahip kurallar detaylandırılmıştır. Anahtar Kelimeler: Viyana Antlaşması, ICC, Incoterms, akreditif

The increasing spread of international trade and the own commercial practices of each country lead to some disputes between the parties. In order to prevent such problems that may arise in foreign trade, the need for the uniformization of trade rules has arisen. In this context, institutions such as the International Chamber of Commerce (ICC) and the United Nations, which have an effectiveness at the global level, have conducted various studies and created exemplary rules on some issues to resolve these disputes. The most prominent of the established rules are the United Nations Convention on Contracts for the International Sale of Goods (CISG) on contracts for international goods created for sales contracts, or the Incoterms rules on the forms of delivery created by the ICC by the Vienna Treaty, Uniform Customs and Practice for Documentary Credits (UCP 600), Uniform Rules for Collections (URC 522) and Uniform Rules (URC 522) and One-Way Rules for Guarantees Demand Guarantees (URDG 758). In the first chapter of this study; the process of globalization, the development of international trade and the documents used in foreign trade and the Vienna Agreement is examined.
