Tebligat Kanunu'na göre elektronik tebligat

Abstract

Tebligat, tebligatı çıkarmaya yetkili mercilerin yapmış olduğu hukuki işlemlerle ilgili olarak hukuki işlem muhataplarının bilgilendirilmesini sağlayan ve bu sürecin belgelendirildiği bir haberleşme aracıdır. Tebligatla ilgili ayrıntılı düzenleme Tebligat Kanunu'nda yapılmıştır. Bu kanunla tebligat sıkı şekil şartlarına bağlanmıştır. Dünya'da teknoloji alanında önemli gelişmeler yaşanmıştır. Bu gelişmeler kendisini devletin yapmış olduğu işlemlerde de göstermiştir. Bu teknolojik gelişmeler Tebligat Hukuku alanına da yansımıştır. Bu sayede tebligatın elektronik ortamda gönderilmesi sağlanmıştır. Ülkemizde elektronik tebligatla ilgili ilk yasal düzenleme 2011 yılında 6099 sayılı kanunla Tebligat Kanunu'nda yapılan değişiklikle hayatımıza girmiştir. Elektronik tebligatta görülen fayda nedeniyle Adli Tebligat Sisteminin Geliştirilmesi Projesi hayata geçirilmiştir. Bu projeyle 01.01.2019 yılında itibaren uygulanmaya başlayan yeni sistemle 7101 sayılı kanunla Tebligat Kanunu m. 7/a hükmünde değişiklik yapılmıştır. Bu değişiklikle elektronik tebligat sistemi ve kapsamı genişletilmiştir. Bu çalışmada elektronik tebligatın yeni sistemi ve adil yargılanma hakkı ve hak arama hürriyetine katkıları ve faydaları üzerinde durulmuştur. Ayrıca elektronik tebligat sisteminin sakıncalı ve aksayan yönlerine de değinilmiştir.

Notification is a communication tool that provides information to legal action counterparts regarding the legal transactions made by the authorities authorized to issue the notification and document this process. Detailed regulation on the notification has been made in the Notification Law. With this law, notification is bound to strict form requirements. There have been important developments in the field of technology in the world. These developments also showed themselves in the transactions made by the state. These technological developments have also been reflected in the field of Notification Law. In this way, it was ensured that the notification is sent electronically. The first legal regulation on electronic notification in our country came into our lives in 2011 with the amendment made in the Notification Law with the law numbered 6099. Due to the benefit seen in electronic notification, the Project for Improving the Judicial Notification System has been implemented. With this project, with the new system that started to be implemented on 01.01.2019, with the law numbered 7101, the Notification Law Art. 7 / a provision has been amended. With this change, the electronic notification system and its scope have been expanded. This study focuses on the new system of electronic notification and its contributions and benefits to the right to a fair trial and the freedom to seek remedies. In addition, the inconveniences and disadvantages of the electronic notification system were also addressed.
