Tedbir nafakası

Abstract

Bu çalışmada, tedbir nafakası konusu ayrıntıları ile izah edilmeye çalışılmıştır. Çalışmamızın yazımında saygı değer hocalarımızın kitapları, doktrin görüşleri, makaleler ve içtihatlar taranarak değerli görüşlerden faydalanılmıştır. Çalışmamızın birinci bölümünde, tedbir nafakası kavramı ve tedbir nafakasının özellikleri hakkında genel bir bilgilendirme yapılmıştır. Çalışmamızın ikinci bölümünde, TMK'da düzenlenen bağımsız tedbir nafakası kavramı, öngörüldüğü hâller ve bağımsız tedbir nafakasına uygulanan usulî hükümler ayrıntılı olarak açıklanmıştır. Üçüncü bölümde ise geçici tedbir nafakası kavramı, koşulları ve geçici tedbir nafakasına uygulanan usulî hükümler izah edilerek, örnek Yargıtay kararları ile de uygulamada yaşanılan sorunlara ışık tutulmaya çalışılmıştır.

In this study, it was tried to explain the details of the issue of temporary alimony. During the writing of our study, the books, doctrinal opinions, articles and case studies of our respected scholars were scanned and valuable opinions were used. In the first part of our study, a general information about the concept of temporary alimony and the characteristics of temporary alimony of measures was provided. In the second part of our study, the concept of independent temporary alimony organized in Turkish Civil Code, the cases envisaged and the procedural provisions applied to independent temporary alimony are explained in detail. In the third chapter, the concept of temporary alimony, its conditions and the procedural provisions applied to temporary alimony are explained and exemplary Supreme Court decisions are also tried to shed light on the problems experienced in practice.
